Non-Adoption Explanation Document

EMTALA Transportation Compliance β€” Official Institutional Disclosure

Pursuant to the National EMTALA Compliance Certification Program administered by The Taya Foundation, healthcare institutions that have not adopted the EMTALA Compliance Certification are required to submit this formal explanation by May 30, 2026, which is ten (10) days following the opening of Phase II on May 20, 2026. This document must demonstrate the institution's existing transportation compliance methodology for High-Risk Discharge and Behavioral Health patient transport.

Mandatory Compliance Notice: Institutions that neither adopt the Certification nor submit this explanation by May 30, 2026 will be documented as having an unresolved EMTALA exposure. This record may be referenced during CMS Corrective Review proceedings. Submission must also be independently transmitted to your State Survey Agency (SSA).

Instructions for Completion

This document is to be completed by an authorized institutional representative β€” typically the Facility Administrator, Chief Compliance Officer, or Director of Patient Transport Services. All fields marked with an asterisk (*) are mandatory.

Upon submission, this document is automatically transmitted to:

  • The Taya Foundation β€” National EMTALA Compliance Review Desk (info@tayafoundation.org)
  • You are independently responsible for carbon-copying your State Survey Agency (SSA).

Submissions received after May 30, 2026 will be recorded as late and may not preclude escalation to Corrective Review.

All submissions to this program β€” including this Non-Adoption Explanation β€” are held in strict confidence. The identity of submitting institutions, their adoption status, and the contents of this document will not be disclosed to any external party, competitor institution, or public registry.

Confirmation of receipt and any follow-up communications will be transmitted exclusively to the authorized contact named in this document. No cross-institutional comparisons, public adoption lists, or institutional rankings will be published without explicit written consent from the institution's authorized representative.

This confidentiality protection applies equally to institutions that have adopted the Certification and those that have not. Participation in this review process β€” in any form β€” will not be publicly reported.

Scope of Disclosure: This section must account specifically for how the institution managed the transport of High-Risk Discharge patients and Behavioral Health patients throughout the calendar year 2025. Incomplete disclosures will be flagged for follow-up.
Current Operations: Identify the transportation model currently in use during 2026 and provide a compliance statement demonstrating how the institution's approach satisfies EMTALA requirements for non-emergency medical transport of high-risk and behavioral health patients.
Forward-Looking Plan: The institution must disclose its planned transportation model for 2027. Institutions indicating intent to adopt LMT-EXPRESS or the EMTALA Compliance Certification are encouraged to specify a projected adoption timeline.
